Gavin Newsom is celebrating a win after a judge ruled last week that his $787 million defamation lawsuit against Fox News can move forward.<\/p><p>Read more <a href=\"https:\/\/sanfranciscomovingguide.com\/?p=43\">Democratic and Republican candidates for Calif. governor lead latest poll<\/a><\/p><\/div><div><img loading=\"lazy\" decoding=\"async\" alt=\"\" aria-hidden=\"true\" class=\"x1px y1px vh abs\" height=\"1\" src=\"https:\/\/cdn-channels-pixel.ex.co\/events\/0012000001fxZm9AAE?integrationType=DEFAULT&amp;template=design%2Farticle%2Fplatypus_two_column.tpl\" width=\"1\"\/><\/div><div><p>Newsom filed the defamation lawsuit in June against the conservative-leaning news network, alleging it misled the public about a phone conversation that took place between the California governor and President Donald Trump during civil unrest that erupted in Los Angeles earlier that month.\u00a0<\/p><\/div><div><\/div><div><p>Judge Sean P. Lugg said in an April 30 decision rejecting the network\u2019s motion to dismiss that he found it \u201creasonably conceivable\u201d that Fox knew the statements were false before making them.\u00a0<\/p><\/div><div><p>\u201cLooking forward to discovery,\u201d Newsom wrote Thursday on X after the judge\u2019s decision, alluding to the legal process where each side turns over documents, including private communications that could be embarrassing.<\/p><\/div><div><p>Fox News said in an emailed statement to SFGATE that Newsom\u2019s lawsuit is an attempt to limit free speech.<\/p><\/div><div><div><div><div><div><div><svg><desc>SF Gate Logo<\/desc><\/svg><\/div><\/div><div><svg><\/svg><\/div><svg><\/svg><\/div><\/div><h3><div>Don&#8217;t let Google decide who you trust.<\/div><\/h3><div>Make SFGATE a preferred source so your search results prioritize writing by actual people, not AI.<\/div><div>Add Preferred Source<\/div><\/div><\/div><div><p>\u201cWe respectfully disagree with the court\u2019s decision and plan to vigorously defend against this frivolous lawsuit as it\u2019s nothing more than a blatant attempt to silence free speech and weaken the First Amendment,\u201d the network said in an email.<\/p><\/div><div><\/div><div><p>The conversation in question took place between Newsom and Trump for 16 minutes on the evening of June 6, according to the court filing. The controversy erupted later after Trump told reporters during a June 10 media conference that he and the governor spoke \u201ca day ago,\u201d when the president called\u00a0Newsom to tell him \u201che\u2019s doing a bad job\u201d during the Immigration and Customs Enforcement protests. Almost a month later, the complaint states, Fox News host Jesse Watters apologized for claiming the governor lied but also questioned why Newsom denied it in the first place.\u00a0<\/p><\/div><div><\/div><div><p>Watters says that Newsom \u201cdidn\u2019t deceive anybody on purpose, so I\u2019m sorry, he wasn\u2019t lying. He was just confusing and unclear. Next time, Governor, why don\u2019t you just say what you mean.\u201d<\/p><\/div><div><p>The whopping $787 million claim could shape how the outlet covers the governor as his term ends later this year and as his expected presidential campaign is anticipated to begin.
