Miceli is now facing up to three years in prison.\u00a0<\/p>\n<\/div>\n<div><\/div>\n<div>\n<p>\u201cHe does not have a significant record, but he is facing a potential jail sentence,\u201d Wagstaffe told SFGATE on Wednesday. \u201cYou can\u2019t overreact to situations with gunfire.\u201d\u00a0<\/p>\n<\/div>\n<div>\n<p>The altercation started on May 23 when three\u00a0Hillsdale High School students poured oil over Miceli\u2019s porch on the \u200b\u200b1000 block of Annapolis Drive in San Mateo, according to incident notes shared by Chief Deputy District Attorney Shin-Mee Chang. The teens targeted Miceli\u2019s home because it was where a female classmate \u201cthey did not like lived,\u201d according to Chang.\u00a0\u00a0<\/p>\n<\/div>\n<div>\n<p>Two days later, the same group of teens, ages 16 and 17, returned and threw raw eggs at Miceli\u2019s home. As they drove away in their SUV, Miceli, who was standing outside with a handgun, shot at the teen\u2019s SUV twice, hitting the passenger side quarter window, according to the incident notes.<\/p>\n<\/div>\n<div>\n<p>Miceli told San Mateo\u00a0police officers who responded to the shooting that his daughter \u201chad been the victim of constant bullying at the high school\u201d and that he was angry about \u201ccleaning oil off the porch,\u201d according to the incident notes. Miceli told police officers that he meant to shoot the SUV\u2019s tires and that he tossed his gun into Waterdog Lake.
