Two former Rohnert Park police officers were sentenced Wednesday in a federal marijuana extortion case that prosecutors say involved years of highway shakedowns targeting cannabis\u00a0motorists along Highway 101, including impersonating federal agents and falsifying police reports.<\/p>\n

Joseph Huffaker, 41, was sentenced on Wednesday to 20 months in federal prison\u00a0for his role in the marijuana extortion scheme, while Brendon Jacy Tatum, 43, was sentenced to 30 months for his role, the\u00a0U.S. Attorney\u2019s Office for the Northern District of California said.<\/p>\n<\/div>\n

This week\u2019s sentencing culminates a yearslong attempt to bring the officers to justice. But for Izaak Schwaiger \u2014 a Sonoma County attorney who represented seven people in civil litigation tied to the Rohnert Park officers\u2019 stops \u2014 the outcome was \u201claughable.\u201d\u00a0<\/p>\n<\/div>\n

\u201cI\u2019m of two minds on the outcome,\u201d Schwaiger told SFGATE. \u201cOne is that it\u2019s good to see that the tide is beginning to turn and that bad cops who break the law are beginning to be held accountable, and that\u2019s something that we can all celebrate.\u201d<\/p>\n<\/div>\n

Still, Schwaiger said the punishment did not reflect the scale of the alleged conduct, noting that if the cops had been \u201cnormal people\u201d robbing highway motorists, they would have gotten a lot more than 20 or 30 months. \u201cThis has been going on for years,\u201d Schwaiger added. \u201cThis is not a one-time thing. These guys did this to hundreds of people over several years. They stole millions of dollars from people and then there was a massive cover-up.\u201d<\/p>\n<\/div>\n

A federal jury convicted Huffaker in July 2025 of extortion under color of official right, falsifying records in a federal investigation, impersonating a federal officer and conspiracy, according to the U.S. attorney\u2019s office. Tatum pleaded guilty in 2021 to conspiracy to commit extortion under color of official right, falsifying records in a federal investigation and tax evasion, and he later testified during Huffaker\u2019s trial.<\/p>\n<\/div>\n

According to federal prosecutors, the two men worked for the city\u2019s police department between 2012 and 2019 and previously participated in a drug interdiction team operating along Highway 101 between Cloverdale and Rohnert Park. The Sonoma County city is located along a major cannabis shipping route between growing regions in Northern California\u2019s Humboldt and Mendocino counties and San Francisco.\u00a0Prosecutors said Huffaker and Tatum continued stopping suspected cannabis transporters even after the department\u2019s interdiction team formally ended, pulling motorists over while off duty and falsely identifying themselves as agents with the Bureau of Alcohol, Tobacco, Firearms and Explosives before seizing marijuana they later sold for profit.<\/p>\n<\/div>\n

Schwaiger said the federal prosecutors focused on a narrow slice of the conduct that victims and defense attorneys have long accused the officers of carrying out.\u00a0<\/p>\n<\/div>\n

\n

\u201cThe crimes for which they were sentenced were fractional [compared] to their complicity,\u201d Schwaiger told SFGATE. \u201cThis is hundreds of victims over many years, and they\u2019re being marginally held to account for what they did to a single person … It\u2019s not enough.\u201d\u00a0<\/p>\n<\/div>\n

The federal case followed years of allegations from cannabis growers, motorists and defense attorneys who accused Rohnert Park officers of conducting pretextual Highway 101 traffic stops to seize marijuana and cash.<\/p>\n<\/div>\n

\u201cIn the criminal defense community in\u00a0Sonoma County, it was not even a secret,\u201d Schwaiger said.<\/p>\n<\/div>\n

\n

He said the accusations had long circulated within\u00a0Sonoma County\u2019s criminal defense community before KQED publicly documented\u00a0multiple motorists\u2019 accounts in 2018. One of those motorists, Mendocino cannabis cultivator Huedell Freeman, told the outlet that officers seized 47 pounds of cannabis he was legally transporting in 2016.<\/p>\n

\u201cAt that moment I knew I\u2019d been had,\u201d Freeman told the outlet. \u201cI knew that this was not a normal traffic stop.\u201d<\/p>\n<\/div>\n

\n

Another lawsuit, filed by Texas resident Ezekial Flatten, alleged Huffaker and another officer stopped him in Mendocino County in December 2017 while he was transporting roughly three pounds of cannabis intended for a testing facility. The suit alleged the officers wore \u201cgreen military-style uniforms with no badges, insignia, or nametags,\u201d identified themselves as ATF agents and left with his cannabis within minutes without issuing a citation.\u00a0<\/p>\n<\/div>\n

KQED previously reported\u00a0that the Rohnert Park Department of Public Safety received more than $1 million in seized cash between 2015 and 2016 through asset forfeiture activity. Tatum, who, according to the federal indictment, supervised the department\u2019s asset forfeiture operations in 2016, was publicly recognized by city officials for his drug interdiction work in 2015.<\/p>\n<\/div>\n

Federal prosecutors later alleged that Tatum personally netted more than $400,000 in illicit proceeds through marijuana sales and tax evasion schemes. Prosecutors said he used structured bank deposits and cashier\u2019s checks to conceal income, including purchases tied to a nearly $47,000 fishing boat.<\/p>\n<\/div>\n

In 2020, Rohnert Park city leaders approved settlements with multiple men who sued the city over marijuana and cash seizures tied to the interdiction stops. Freeman received $287,500, while seven other motorists split a $1.175 million settlement. The city also separately settled with Flatten for $415,000.<\/p>\n<\/div>\n

\n

According to a grand jury indictment, the FBI began investigating after receiving a 2018 complaint from someone who said they had been shaken down by police on Highway 101. Prosecutors said Huffaker and Tatum then falsified a police report about a Dec. 18 traffic stop and marijuana seizure, and Tatum forwarded the falsified report and a press release to the FBI agent investigating the stop, according to another complaint.\u00a0<\/p>\n<\/div>\n

Tatum later admitted in his plea agreement to stealing marijuana from the\u00a0Rohnert Park police station, extorting marijuana from motorists on Highway 101, selling marijuana for personal profit, and evading taxes in 2015 and 2016, the U.S. attorney\u2019s office said.<\/p>\n<\/div>\n

Tatum left the Rohnert Park Department of Public Safety in 2018 after KQED reported on the allegations against him. Huffaker later left the department in early 2019 under a settlement agreement with the city. Former Rohnert Park Police Chief Brian Masterson also retired in 2018.<\/p>\n<\/div>\n

In addition to prison time, Huffaker and Tatum were sentenced to three years of supervised release. Tatum was ordered to pay $301,145.70 in restitution, while Huffaker was ordered to pay $20,000. Huffaker is scheduled to begin serving his sentence on Sept. 15.\u00a0Tatum is scheduled to report Jan. 11, 2027.<\/p>\n<\/div>\n

Schwaiger said he hopes the convictions send a message to officers tempted to abuse their authority. \u201cI hope it says that somebody is watching,\u201d he said. \u201cEven if I don\u2019t think they\u2019re watching enough.\u201d<\/p>\n<\/div>\n
